2. Lastly, the bail petition of petitioner was rejected, vide order dated 22.06.2022 passed in Cr.Misc. No. 19441 of 2022.

3. The trial court report, which was called for vide order dated 06.10.2023, reveals that in this case, charge has been framed on 13.07.2022 and thereafter, summons and bailable warrant of arrest have been issued to the charge-sheeted witnesses, but till the date of report of learned Addl. Sessions Judge, Sherghati, Gaya, not a single witness has been examined on behalf of prosecution and the case is pending for evidence. Petitioner is in custody since 17.07.2020 i.e. 3 years and 5 months.

4. Considering the period of custody and tardy progress of trial, the prayer for bail of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, Sherghati, Gaya in connection with Imamganj P.S. Case No. 128 of 2020 corresponding to Sessions Trial No. 195 of 2022 / 1092 of 2023.
