The petitioner apprehends his arrest in Sour Bazar P.S. Case No. 67 of 2013, registered for the offences punishable under Sections 420 and 34 of the Indian Penal Code. The informant alleged that the petitioner took demand draft of Rs. 80,000/- and cash of Rs. 20,000/- from the informant for installing mobile tower in a piece of land, but neither the tower was installed nor money was returned.
Learned counsel for the petitioner submits that after two years of the occurrence the case was filed. Three persons including the petitioner are alleged to have taken demand draft of Rs. 80,000/- and cash of Rs. 20,000/- from the informant and the petitioner is ready to pay his entire share to the informant.

No.36136 of 2014 (3) dt.18-03-2015 2/2 Considering the facts aforesaid and the fact that if the petitioner pay Rs. 35,000/- to the informant within one month, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 67 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
