24-11-2015 Heard Sri Krishna Deo Raj, learned counsel for the petitioner and learned A.C. to Govt. Advocate - 9. The petitioner, invoking writ jurisdiction of this Court, has prayed for directing the respondents to promote and post him as Headmaster.

It has been stated that though the petitioner has filed representation before the District Superintendent of Education (presently it is known as District Education Officer), no decision has been taken.

The Court is of the opinion that instead of going into the merit of the case, the writ petition can be disposed of granting liberty to the petitioner to file fresh representation before the

Patna High Court CWJC No.5779 of 2011 (3) dt.24-11-2015 2/2 District Education Officer, West Champaran, Bettiah regarding his claim, which has been raised in the present writ petition. If such representation is filed within six weeks from today, the District Education Officer may examine and pass appropriate order in accordance with law within a period of three months thereafter.
