The sole petitioner, apprehending his arrest in connection with Simri P.S. Case no.57/2013 registered for the offence under Sections 304(B)/34 of the Indian Penal Code, has prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that the petitioner is maternal uncle of the husband of the deceased and in this case almost all accused persons have been granted bail; some have been enlarged on bail under the provision of Section 167(2) of the Code of Criminal Procedure and some have been extended the privilege of anticipatory bail.
Patna High Court Cr.Misc. No.5723 of 2016 (2) dt.19-02-2016 2/2 After some argument, learned counsel for the petitioner makes a prayer for disposal of the anticipatory bail petition, so that the petitioner may appear before the court below and make a prayer for regular bail.
The anticipatory bail petition stands disposed of with liberty as indicated above.
It goes without saying that if the petitioner appears before the court below within six weeks and makes a prayer for regular bail, learned court below, without being prejudiced with this order and considering the fact that other accused persons have been granted bail, may examine the same on merits and pass appropriate order in accordance with law preferably on the same day.
