Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the victim.

The petitioner seeks bail in connection with Baheri PS Case No. 219 of 2023, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is not named in the FIR and he came to be implicated in the instant case during the course of investigation based on confessional statement of Gulshan Kumar @ Tiger and Satyam Kumar @ Tyagi. It is further submitted that the occurrence is alleged to have occurred on 22-6-2023 at about 4:45 pm, when the FIR came to be instituted by one Kundan Singh, who was driving the Bolero vehicle in which all the three deceased were sitting and

Patna High Court CR. MISC. No.52795 of 2024(2) dt.25-10-2024 2/2 were heading to attend marriage function, when the vehicle was intercepted by unknown accused persons, who committed the occurrence.

Learned counsel for the petitioner next submits that petitioner in the instant case came to be implicated because of his antecedents.

Learned counsel appearing on behalf of the victim submits that petitioner is a dreaded criminal and carries a reward of Rs. 2 lakh on his head and was arrested by the STF from Ranchi. It is also submitted that the FIR was instituted by Kundan, but during the course of investigation, Kundan was also made an accused as he was the person involved in getting the occurrence committed in which three innocent persons were brutally murdered.

Considering the submissions made by the learned counsel appearing on behalf of the victim, the Court is not inclined to release the petitioner on bail.

Accordingly, the prayer for regular bail of the petitioner is rejected.
