The petitioner is languishing in custody for the offence punishable under Section 366/34 of the Indian Penal Code.
According to FIR, co-accused Anup Mahto son of this petitioner is alleged to have induced the wife of the informant to go with him and thereafter kidnapped her.
The victim lady in her statement under Section 164 Cr.P.C. has supported the allegation against Anup Mahto and has also stated that the petitioner met on the way and he also assisted Anup Mahto. No further allegation is there.
Submission is that the matter might be of love-
Patna High Court Cr.Misc. No.26099 of 2018 (2) dt.01-05-2018 P2/ affairs between the son of the petitioner and wife of the informant. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ekma P.S. Case No.161 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
