JUSTICE BIRENDRA KUMAR ORAL ORDER 30-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 363/370/34 of the Indian Penal Code. Later on offence under Sections 302/201/34 of the Indian Penal Code was added.

According to FIR, the son of the informant was working in the shop of the petitioner. Subsequently, he was found missing and later on his dead body was recovered. Suspicion was raised against the petitioner and his wife of commission of death. Learned counsel for the petitioner submits that the trial is going on. Several witnesses including the informant have been examined in this case. Informant has specifically stated that

Patna High Court Cr.Misc. No.25705 of 2018 (2) dt.30-04-2018 P2/ he has no suspicion against the petitioner in the matter of any role in the death of his son. The brother of the deceased has also been examined during trial but he has not supported any allegation against the petitioner.

In the aforesaid circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Jalalgarh P.S. Case No.84 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
