The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the Indian Penal Code. Earlier this Court vide order dated 21.11.2013 passed in Cr. Misc. No.46783 of 2013 rejected the prayer for bail of the petitioner with a liberty to conclude the trial within nine months.
The name of the petitioner has been surfaced on the basis of the confessional statement of Lal Deo Paswan. First Information Report has been lodged against unknown. In the present case altogether four witnesses have been examined and certified copy of the deposition has been placed before the
Patna High Court Cr.Misc. No.38294 of 2014 (4) dt.21-01-2015 Court for its perusal, it appears that all the witnesses have turned hostile. Petitioner is in jail since 12.6.2013. Looking to the facts and circumstances of the case, let petitioner, Ramjee Paul @ Ramji Paul, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J. IV, Aurangabad (Bihar) in S.T. No.301(A) of 2003/75 of 2013, arising out of Deo P.S. Case No.53 of 2001, subject to the conditions that petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
