2. The petitioner seeks bail in connection with Bhimnagar P.S. Case No. 46 of 2025 registered for the offence punishable under sections 137(2) and 96 of the B.N.S.

3. As per the prosecution case, on 24.06.2025 at about 05:00 A.M., the petitioner along with co- accused persons came to the house of the informant and forcibly kidnapped the daughter of the informant with the intention of committing wrongful act and kept her hidden in some secret place. It is also alleged that gold worth Rs. 16,00,000/- and Rs. 1,25,000/- cash is also taken away by the petitioner along with the co- accused

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to village politics by legal and litigant brain. He further submits that petitioner is the father of the co-accused Akash Kumar due to which his name has falsely been implicated. He next submits that co-accused persons have been granted bail by a Co-ordinate Bench of this Court vide order dated 06.04.2026 passed in Cr. Misc No. 22349 of 2026. The petitioner is in custody since 30.11.2025 and he has two criminal antecedents in which he is on bail.

5. Learned APP appearing on behalf of the State vehemently opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and also submission of learned counsel for the petitioner, let the above named petitioner be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned A.C.J.M., Birpur, District- Supaul in connection with Bhimnagar P.S. Case No. 46 of 2025, subject to the following conditions:

(i) Petitioner shall co-operate in the trial and shall be

No.50179 of 2026(2) dt.22-07-2026 3/3 properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. (ii) If the petitioner tampers with the evidence or the witness, in that case, the prosecution will be at liberty to move for cancellation of bail.

(iii) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedents, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
