In this case, the petitioners are seeking bail in connection with West Saraiya P.S. Case No. 283 of 2015 registered for offences under Sections 395 and 397 of the Indian Penal Code. As per the FIR, the miscreants had entered into the house of the informant in the midnight and started assaulting to all family members by lathi and danda. The victim lady had claimed that she identified these petitioners.
Looking to the facts and circumstances of the case, this Court is not inclined to grant them bail. Hence the application is rejected. The court below is directed to expedite the trial and
Patna High Court Cr.Misc. No.57124 of 2015 (3) dt.19-02-216 2/2 complete the same within a year. If the trial is not completed within a year, the petitioners will be at liberty to renew his prayer for bail.
