The petitioners apprehend their arrest in Chainpur P.S. Case No. 24 of 2003 under Sections 302/307 and other sections of the Indian Penal Code and Section 27 of the Arms Act. The petitioners are named in the F.I.R. One Bahadur Bind is alleged to have fired at the father of the informant. Nanhey Bind fired at Machhendra Bind and Parmeshwar Bind fired at Surendra Bind. Allegation against the petitioners is that they assaulted the informant and others. The police, after investigation, submitted chargesheet.
It is submitted that the case is of the year 2003. The petitioners received summons as the police has already submitted chargesheet against the petitioners. The case is compromised. Considering the facts that the case is of the year 2003
Patna High Court Cr.Misc. No.37593 of 2014 (2) dt.18-03-2015 2/2 and the petitioners also assaulted the informant and other members of the mob opened firing in which the father of the informant died, hence, I am not inclined to enlarge the petitioners on anticipatory bail in Chainpur P.S. Case No. 24 of 2003. Accordingly, the same is rejected.
