ANJANA MISHRA ORAL ORDER 16-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since16.10.2017 in connection with Tajpur P.S. Case No. 298 of 2017 registered for the offences punishable under Section 379/457of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was earlier taken into custody in connection with Sarairanjan P.S. Case No. 194 of 2017. In the said case, the recovery of the motorcycle is the same which is alleged to be recovered in connection with the present case. It is further submitted that in Sarairanjan P.S. Case No. 194 of 2017, the petitioner has already been granted bail vide order dated 30.01.2018 passed in Cr. Misc. No. 5115 of 2018 wherein it has

Patna High Court Cr.Misc. No.25299 of 2018 (2) dt.16-05-2018 2/2 been clearly recorded that the recovery of motorcycle was only from co-accused Salu Sahani and not this petitioner, therefore, the same recovery cannot be attributed to the present petitioner in connection with the present case.

In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Samastipur, in connection with Tajpur P.S. Case No. 298 of 2017.
