JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376/511, 323, 379 and 452 of the Indian Penal Code.
The prosecution case is that the petitioner tried to ravish the informant and when complaint was made to the family members of the petitioner then mother and brother of the informant were assaulted and jewellery of the mother of the informant was snatched.
It is submitted by learned counsel for the petitioner that informant is the own cousin of the petitioner and due to strand relationship, the accusation has been levelled. There is no medical report of the informant on record. For the occurrence of 09.09.2015, the complaint was flied on 15.09.2015 which came to
Patna High Court Cr.Misc. No.6679 of 2016 (2) dt.12-02-2016 2/2 be registered on 26.11.2015.
Delayed lodging of the case constitutes good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Ganga Bridge P.S. Case No. 99 of 2015 pending in the court of learned CJM, Vaishali at Hajipur. Accordingly, the application is disposed of.
