2. In this case, the petitioner is seeking regular bail in connection with Bochaha P.S. Case No. 289 of 2023, registered for the offences punishable under Sections 279, 337, 338, 304(A), 341, 323, 307 and 304/34 of the Indian Penal Code.

3. As per allegation, when the informant was coming from the house of his sister with cash, a Tempo running rashly and negligently fled away after dashing his pulsar motorcycle and he and his brother became injured at the place of occurrence. During treatment, his brother, Rajnish Kumar died and the informant's treatment was going on at the time of

4. The learned counsel for the petitioner has submitted that from perusal of the F.I.R., it shows itself that it is a case of causing death by rash and negligent driving and it was not intention of the petitioner to kill the deceased. The petitioner is under custody since 21.05.2025. He has submitted further that although the petitioner has one criminal antecedent but it is not of similar nature and the petitioner is on bail in that case. He has also submitted that on similar footing, co-accused Summit Kumar has been granted regular bail by this Court vide order dated 26.09.2024 in Cr. Misc. No. 66955 of 2024.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- 9th, Muzaffarpur (East) in connection with Bochaha P.S. Case No. 289 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

6. Before accepting the bail bonds, the learned court below shall verify the criminal antecedents of the petitioner and if it is found that he is involved in any other
