JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 376, 511, 34 of the Indian Penal Code.
The prosecution case is that informant's daughter Abha Kumari aged about 12 years was coming from milk centre when her bicycle and Rs. 1900/- was snatched and petitioner and two others made an attempt to ravish her. It is submitted by learned counsel for the petitioner that for the occurrence of 03.10.2015 at 5:30 P.M the F.I.R was registered on 04.10.2015 at 4:00 P.M and since informant's family was grazing the crops of the petitioner and cattle of the informant was caught, hence the false accusation has been levelled. It is further submitted that victim was not medically examined.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.6144 of 2016 (2) dt.08-02-2016 2/2 petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Panapur P.S. Case No. 109 of 2015, pending in the Court of learned Sub-Judge-IV/A.C.J.M, Saran at Chapra. With the observations above, the application stands disposed off.
