JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he got job of constable by playing fraud upon the officials but in course of enquiry, the aforesaid fact was detected and accordingly, the present case was lodged against the petitioner. The contention on behalf of the petitioner is that the present case is said to be based upon hand writing and thumb impression of the petitioner as well as signature and thumb impression found on the answer sheets but the aforesaid signatures and thumb impressions were never examined by an expert. Moreover, petitioner has already been dismissed from service and is languishing in jail custody since 12.10.2015.

No.57324 of 2015 (2) dt.21-12-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI, Muzaffarpur in connection with Ahiyapur P.S. Case No. 941 of 2015.
