The petitioner apprehends his arrest in Riga P.S. Case No.322 of 2017 registered under Sections 363, 366(A) and 34 of the Indian Penal Code.

The informant (father of the victim) alleged that the petitioner with the help of his parents kidnapped the minor daughter of the informant.

Learned counsel for the petitioner submits that the victim made her statement under Section 164 of the Cr.P.C. and the victim herself disclosed that she voluntarily left her house and went along with the petitioner to different places to solemnize marriage with the petitioner. The victim denied the factum of her kidnapping.

Having considered the fact that the victim herself

No.47280 of 2019(2) dt.30-07-2019 2/2 denied the factum of her kidnapping and she disclosed her age to be 19 years in her statement under Section 164 of the Cr.P.C., above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Riga P.S. Case No.322 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
