====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-12-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 308, 379, 504 and 506 of the Indian Penal Code. Specific allegation of assault is against co-accused Anil Kumar and Asarfi Thakur.
There is no allegation of overt act against the petitioners. Learned counsel appearing for the State vehemently opposes the prayer for bail.
Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners,
Patna High Court CR. MISC. No.50151 of 2022(2) dt.15-12-2022 2/2 above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Raxaul, East Champaran at Motihari, in connection with Chhauradano P.S. Case No. 302 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
