Petitioner, already in custody, seeks bail in connection with Hajipur Town P.S. Case No.725 of 2017, registered under Sections 376, 313, 379, 328, 420 and 506 of the Indian Penal Code as well as under Sections 66(A) and 66(E) of the I.T. Act, 2017.
Allegation in brief is that the informant, a dancer, got acquaintance with the petitioner and alleged that on the promise to marry with her, the petitioner sexually exploited her as a result the informant became pregnant and the same was terminated and later on the informant learnt that the petitioner was already married.
Learned counsel for the petitioner submits that there
Patna High Court Cr.Misc. No.27580 of 2018(2) dt.08-05-2018 2/2 was a written agreement between the petitioner and the informant and due to the dispute, the informant came to the house of the petitioner, abused and assaulted the family members and in that context the petitioner's wife two days prior to the lodging of the present case had lodged FIR against her, so as a retaliatory step, the informant lodged this false case. Having considered the aforesaid facts and circumstances and the nature of earlier dispute between both sides, petitioner Sunil Kumar Singh @ Dabloo is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No.725 of 2017.
