The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A, 370 of the Indian Penal Code.

The accusation is of abducting the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that in 164 Cr.P.C. statement the victim got her age recorded 18 years, the Court also assessed her aged 18 years but during medical examination of the informant the Doctor found her age between 16-17 years. The victim has stated in her 164 Cr.P.C. statement that she of her own went in the company of the petitioner and married with him. The Doctor has not found any sign of rape.

Patna High Court Cr.Misc. No.6426 of 2016 (2) dt.11-02-2016 Considering the 164 Cr.P.C. statement of the victim, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P.S. Case No. 441 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
