JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 10.7.2017 in Cr.Misc.No. 25041 of 2017 with a direction to learned trial court to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that till date only one witness has been examined and there is no substantive progress in trial and petitioner is in custody for more than one year.

Heard learned APP also.

Having heard both sides and in the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.26664 of 2018 (2) dt.02-05-2018 2/2 satisfaction of Additional District and Sessions Judge, Rosera, Samastipur, in connection with Sessions Trial No. 535 of 2017, arising out of Bibhutipur P.S.Case No.209 of 2015, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and petitioner will co-operate in trial and appear in the court below as and when required, failing which his bail bond shall stand cancelled.
