JUSTICE SHIVAJI PANDEY ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and learned counsel for the State as well as the informant. The petitioner seeks bail in a case instituted for the offences under Sections 341, 367, 370, 371 and 120-B of the Indian Penal Code and Sections 3(2)(v) of SC/ST (Prevention of Atrocities) Act.

As per FIR it has been alleged that petitioner and other accused persons have forcibly caught the informant, took him to a house and started assaulting him. He started weeping. Two men and one woman were there from before. When the family members could know about this incident and their confinement they informed the police and with the help of the police personal they were released. It has been alleged that

Learned counsel for the petitioner submits that allegation that has been made by the informant that he was taken away by the accused persons and they used to work for accused persons in every year. Petitioner is in jail since 16.10.2015 and he has no criminal antecedent. Looking to the nature of allegation, let petitioner, Suresh Singh, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 137 of 2015, subject to the condition that petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
