JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act.

From the house of the petitioner 60 litres of country made liquor and 200 Kg of fermented mahua were seized.

It is submitted by learned counsel for the petitioner that seizure has been made from the joint family house and the quantity has been assessed on speculation. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with G.O. Case No. 447 of 2014/1413 of 2015, pending in the Court of

Patna High Court Cr.Misc. No.6559 of 2016 (2) dt.11-02-2016 2/2 learned Chief Judicial Magistrate, Nawada.

With the observations above, the application stands disposed off.
