JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners are accused in connection with Siwaipatti P.S. Case No. 107 of 2015 registered under Sections 399, 402, 414 of the I.P.C. and 25(1-B), 26/35 of the Arms Act. Learned counsel appearing on behalf of the petitioners submits that it would appear from the F.I.R. that petitioners and three others have been apprehended by the Police mere on suspicion, while Nagina Singh and Ram Balam Sahni were found in possession of country made pistol, live cartridges and pipe gun but nothing has been recovered from the possession of both petitioners. It is further submitted that petitioners have no criminal antecedent and are in custody since 23.09.2015.

Patna High Court Cr.Misc. No.56322 of 2015 (2) dt.16-12-2015 2/2 Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur in connection with Siwaipatti P.S. Case No. 107 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioners.
