JUSTICE ARUN KUMAR ORAL ORDER 18-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 28.8.2017 seeks bail in Bidupur PS Case No. 261 of 2017, S.T. No. 20 of 2018 registered under Sections 302, 120B of the IPC and Section 27 of the Arms Act.
The allegation in brief is that the informant's husband had gone in the morning for walk along with one Manshi Rai and while returning back on the way he was intercepted by three motorcycle borne criminals and they killed him. It is alleged by the informant that she came out hearing gun shot firing and saw three-four named persons including the petitioner running away to their house and it is alleged that due to land dispute her husband was eliminated by the contract killers.
Learned Counsel for the petitioner submits that there is accusation that contract killers had killed the informant's husband and not the petitioner, all the accused persons have been implicated in this case due to land dispute, Manshi Rai who is eye witness and had gone for walk along with the deceased was not interrogated by the police during investigation so only suspicion is raised against the
Patna High Court Cr.Misc. No.30078 of 2018 (4) dt.18-07-2018 petitioner because of the land dispute.
Having considered the said facts and circumstances, the petitioner, namely, Brij Kishore Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Vaishali at Hajipur in connection with Bidupur PS Case No. 261 of 2017, S.T. No. 20 of 2018..
