JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-12-2022 In pursuance to the order of this Court dated 03.11.2022, a supplementary counter affidavit has been filed by the District Magistrate, Supaul, wherein it has been admitted that no final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 has been passed by the Circle Officer, Triveniganj i.e. respondent no. 5, in connection with Encroachment case no. 15 of 2020-21.
In view of the aforesaid, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to file appropriate reply/ objection before the respondent no. 5, in connection with the aforesaid encroachment case, within a
Patna High Court CWJC No.17854 of 2021(3) dt.07-12-2022 2/2 period of four weeks from today. Liberty so sought is granted. It is needless to state that in case, appropriate reply/ objection is filed within a period of four weeks from today, the respondent no. 5 shall consider the same and pass the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, within a period of eight weeks, thereafter and till then, status quo existing as on today qua the land/ house of the petitioner in question, shall be maintained.
The writ petition stands disposed off on the aforesaid terms.
