JUSTICE RAKESH KUMAR ORAL ORDER 22-02-2016 Heard Sri Satish Chandra, learned counsel for the petitioner and Mr. Md. Ashlam Ansari, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in connection with Pipra P.S. Case no.28/2015 registered for the offence under Sections 272, 273 of the Indian Penal Code, Section 47(A) (F), 48, 13(F) of the Excise Act and Section 2(e) 3/5(b)/18 Bihar Mahua Phool Rule 2006, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that about 1750 Kg of Mahua Phool was recovered from the house of the petitioner. He submits that the petitioner has falsely been implicated . Initially the driver of Pick-up van was apprehended

Patna High Court Cr.Misc. No.5802 of 2016 (2) dt.22-02-2016 2/2 and at the instance of the driver, the petitioner's name has been incorporated in the case.

In view of nature of accusation, let the petitioner, namely, Prabhu Manjhi , in the event of his arrest or surrender within six weeks from today , be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi at Patna in connection with Pipra P.S. Case no.28/2015 , subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) NKS/- U
