2. The petitioner has preferred this application for grant of regular bail in connection with K. Hat P.S. Case No.194 of 2025, dated 14.05.2025 registered for the offences punishable under Sections 126(2), 127(2), 115(2), 308(2) and308(5) read with Section 3(5) of the BNS
3. As per the prosecution case, on 14.05.2025 at about 12:00 PM, the informant along with his friend was going to Max Hospital by car carrying Rs. 1,50,000/- in a bag to pay for the operation of his elder sister admitted in the said Hospital. It is further alleged that informant's car was stopped near Chhuni Urao Chowk by the patrolling party and the accused persons
Patna High Court CR. MISC. No.49651 of 2025(2) dt.19-08-2025 2/3 took informant's bag and out of Rs.1,50,000/-, they took Rs. 1,10,000/- and left the rest money. It is further alleged that when the informant demanded his money, he was threatened by them.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the course of investigation. The other co-accused person has already been granted bail by this court vide order dated 30.07.2025 passed in Cr. Misc. No. 44924/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 14.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with K. Hat P.S. Case No. 194/2025.
