22-01-2016 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Khagaria P.S. Case No. 500/2015 registered for the offences punishable under Section 467, 468, 471, 420, 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that the present petitioner is the vendee who has taken the land belonging to Sureshwar Prasad Singh in the district of Khagaria through valid sale deed executed by his sons. The present prosecution has been lodged against him by one Vijay Singh Gautam who in fact after taking power of attorney from the said Sureshwar Prasad Singh has been misusing the same and
Patna High Court Cr.Misc. No.57624 of 2015 (2) dt.22-01-2016 2/2 many such vendees who are now facing prosecution on account of high handedness of the present informant.
He further submits that the son of the said Dr. Sureshwar Prasad Singh, who is now settled in England has written a letter to the Superintendent of Police Khagaria vide e-mail dated 28.11.2015 requesting urgent intervention to the Superintendent of Police to stop illegal lease of ancestral properties belonging to the father of the said sender of the e-mail.
Considering the nature of allegation against the petitioner and there being positive material on record to prove that the petitioner is not involved in the said transaction, let the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 500/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Vinita/- U T
