2. The petitioner has preferred this application for grant of regular bail in connection with Angarghat P.S. Case No. 37 of 2025 dated 03.04.2025 registered for the offences punishable u/ss 30(a) and 41(1) of the Bihar Prohibition and Excise Act, Sections 25(1-B)(a), 26 and 27 of Arms Act and Sections 274 and 275 of B.N.S.

3. As per the prosecution case, total 80.695 litres of illicit foreign liquor, one country-made pistol, 10 live cartridges and 18 empty cartridges were recovered from the house of the coaccused, Surydev Kumar.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the

Patna High Court CR. MISC. No.50947 of 2025(3) dt.30-08-2025 2/2 petitioner has surfaced in this case during the course of investigation. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The co-accused person has already been granted regular bail by this court vide order dated 16.07.2025 passed in Cr. Misc. No. 46539/2025. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 10.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur in connection with Angarghat P.S. Case No. 37 of 2025.

7. The application stands allowed.
