By the impugned order the learned court below has restored the proceeding of the suit to its original file on the prayer made by the plaintiff on that suit.

After perusal of the impugned order which has been passed after elaborate consideration of the evidence led on behalf of the parties, this Court does not find it a fit case to invoke the jurisdiction under Article 227 of the Constitution of India for interdicting the impugned order.

The application is, accordingly, dismissed.
