Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 3.4.2017 passed in Cr. Misc. No49807 of 2017.
Submission of the learned counsel for the petitioner is that he is in custody for 21 months. The trial has not been concluded though there is direction to the learned trial court to conclude the same within a period of nine months and he is not responsible for the defalcation.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty
Patna High Court Cr.Misc. No.25399 of 2018 (2) dt.02-05-2018 2/2 Five Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist class, Patna in connection with Kankarbagh P.S.Case nO.567 of 2014, with condition that he will co-operate in disposal of the trial and he shall not be absent except showing genuine reasons, otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
