Petitioner is apprehending his arrest in connection with Motipur P.S.Case No.134/2019 corresponding to G.R.No.815/2019, registered for offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation as per the Fardbeyan is that the informant was called on phone by Ashok Paswan and when he came the petitioner and other accused persons were there and one coaccused Jetendra Bhagat ordered on which Jeetendra Bhagat and Jiya Lal Bhagat fired at him causing injury to him. Submission of the learned counsel for the petitioner is that except that he was present there, there is no allegation

Heard learned A.P.P. , who has opposed the prayer for bail on the ground that under a common intention, they were there and some of the accused fired on him. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM (West) Muzaffarpur in connection with Motipur P.S.Case No.134 of 2019 corresponding to G.R.No.815/2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
