The petitioner has filed the instant application for grant of regular bail in connection with Arwal P.S. Case no. 186/2020 registered under sections 302 and 34 of the Indian Penal Code. As per the allegation in the first information report, it is stated by the informant that the son of her elder sister informed her on telephone about the death of her brother. It is stated by the informant that on going to her brother's place he found him dead, having died as a result of hanging. She thereafter narrates about the differences amongst the family member as also others including the petitioner herein.
It is submitted by learned counsel for the petitioner that admittedly the informant is not an eye-witness of the occurrence. At
Patna High Court CR. MISC. No.6706 of 2021(3) dt.29-06-2021 2/2 best she has raised some unfounded suspicion against the accused persons. No material has transpired in course of investigation to connect the petitioner with the alleged crime. Co-accused Sawan Kumar has been enlarged on bail vide order dated 25.5.2021 passed in Cr. Misc. no. 3309/2021. The petitioner is in custody since 8.6.2020 and has no criminal antecedent.
The application for bail is opposed by learned Additional Public Prosecutor for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including grant of bail to co-accused Sawan Kumar and the petitioner having remained in custody for more than 1 year, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Arwal P.S. Case no. 186/2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VII, Jehanabad.
