2. The petitioner has preferred this application for grant of regular bail in connection with Riga P.S. Case No. 56 of 2025 dated 15.02.2025 registered for the offences punishable u/ss 137, 96, 64 read with Section 3(5) of the B.N.S. and Sections 4 and 6 of the POCSO Act.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have kidnapped the minor daughter of the informant for the purpose of marriage. Thereafter, the informant searched his daughter but she did not
Patna High Court CR. MISC. No.48302 of 2025(2) dt.18-08-2025 2/3 trace out. On 13.02.2025, the accused persons left the informant's daughter in the village and fled away from there. It is further alleged that the informant's daughter disclosed that the petitioner committed wrong with her.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The occurrence took place on 12.02.2025 but the F.I.R. was lodged on 15.02.2025 and there is no explanation for this delay. There was love affair between the victim and the petitioner. Learned counsel has further submitted that there is no medical evidence on record in support of allegation made by the informant that the petitioner committed wrong with the victim. It is further submitted that the matter has been compromised and there is no dispute between the parties and a copy of the compromised petition is annexed as Annexure -P/2 with the bail petition. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 07.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. Learned counsel for the informant has submitted that the matter has been compromised and there is no dispute between the parties.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Riga P.S. Case No. 56 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
