JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-10-2021 Heard Mr. Rajiv Kumar, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Jamo Bazar P.S. Case No. 120 of 2019, instituted for the offences under Sections 307, 341, 323, 324, 379, 354(B), 504 and 506/34 of the Indian Penal Code.
The accusation against the petitioner is of
Patna High Court CR. MISC. No.5816 of 2021(2) dt.08-10-2021 2/3 assaulting the informant on her head by means of a sharp cutting weapon.
The learned counsel for the petitioner has pointed out that the injuries suffered by the informant on her head is simple in nature and is stated to have been caused by hard and blunt substance. It has further been submitted that there is a counter version of the case lodged by the mother of the petitioner in which transaction, the mother and brother of the petitioner have also been injured. There is no reference of the cause of injuries on the mother and brother of the petitioner, which makes the accusation in the subject F.I.R. highly suspicious. It has also been submitted that there appears to be some dispute between the two families for which case and counter case has been lodged. For the reasons afore-stated, the petitioner abovenamed, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.5816 of 2021(2) dt.08-10-2021 3/3 learned 13th Additional Chief Judicial Magistrate, Siwan in connection with Jamo Bazar P.S. Case No. 120 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
