JUSTICE BIRENDRA KUMAR ORAL ORDER 27-04-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are in custody in connection with Gandhi Maidan P.S. Case No.36 of 2018, a case under Section 387 of the Indian Penal Code.
According to FIR ransom was demanded on mobile call.
Submission of the learned counsel for the petitioners is that the said mobile was of co-accused Diwakar Guha. Name of the petitioners surfaced in the confessional statement of co-accused Sumesh Kumar. Petitioners have got no criminal antecedent. They are in custody since 09.02.2018.
Patna High Court Cr.Misc. No.25433 of 2018 (2) dt.27-04-2018 P2/ Considering the entire facts of the case, let the petitioners, above named, be released on bail after completion of investigation of the case on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gandhi Maidan Police Station Case No. 36 of 2018, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. If the investigation is already complete the learned Court-below shall accept the bail-bonds of the petitioner immediately.
