The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 498A and 304B/34 of the Indian Penal Code.

The prosecution case is that the daughter of the informant was killed after four years of marriage for nonfulfillment of dowry. It is submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 28.06.2011 and the victim died due to the accidental burn injuries

The report of the learned trial court dated 23.01.2016 reflects that four charge-sheeted witnesses have been examined and only I.O. and doctor are yet to be examined. The report does not reflect that when the last witness was examined and what effort has been taken by the learned trial court since 04.08.2015 when the records were transferred to him. It appears that learned trial court while preparing report did not bother to go through the earlier order of this Court, whereby the trial court was directed to proceed expeditiously avoiding undue delay and adjournments. The report also does not stipulate that how many witnesses have been cited in the charge-sheet. It is expected from the learned trial court to be carefully while transmitting report to this Court. Considering the present stage of the trial, this Court is not inclined to interfere.

It is expected from the learned trial court to conclude the trial within a period of five months from the date of receipt/production of a copy of this order. If, the trial will not be concluded within a period of five months then the petitioner will be at liberty to renew his prayer for bail.
