JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioner seeks regular bail in connection with Siwan Town P.S. Case No. 271/2019 registered for the offence punishable under Sections 419, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code.
Prosecution case is that an information was received by Branch Manager, Allahabad Bank that two boys have to withdraw the amount of Rs. 49000/- on the basis of forged cheque, police reached there, arrested the those accused persons including the petitioner and it was detected that earlier also Rs.49000/- was withdrawn from account of informant and Rs. 6,50,000/- was transferred to the account of other accused through R.T.G.S.
Submission of the learned counsel for the petitioner is that the other co-accused person, who has also been arrested,
Patna High Court CR. MISC. No.47245 of 2019(5) dt.04-02-2020 2/2 has been granted bail on the plea of juvenile. He is in custody since 24.04.2019, having no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides, in view of the submissions, made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Siwan Town P.S. Case No. 271/2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to cooperate in disposal of the trial and appear as and when required and also on condition that he has to appear before the S.H.O. of police station of his local area for the period of nine months, so that his activities may be watched and if he is found involved in such type of cases in future or non-compliance of above direction, the prosecution shall be at liberty to move for cancellation of his bail bonds.
Let a copy of this order be communicated to the S.P., Siwan, for needful.
