3. It is submitted by Mr. Amresh Kumar Sinha, learned counsel for the petitioner, that in view of the stage of trial being changed on account of charges having been framed, the petitioner is availing his remedy of bail before the learned lower court.

4. In view of such development, he does not wish to press this application. Accordingly, the application is dismissed as withdrawn.

5. This Court would only observe that since the withdrawal is to avail the remedy of bail, before the learned lower court, the withdrawal of the case should not prejudice the case of the petitioner in the Court below. The order is being
