1. Heard Mr. Pushpendra Kumar Singh, learned counsel for the petitioner and Mr. Rajendra Nut, learned APP for the State.

2. The petitioner seeks regular bail in connection with Sheohar P.S. Case No. 42 of 2025 dated 06.02.2025 registered for the offence(s) punishable under Section(s) 303(2) of the B.N.S., 2023.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is a young person and has been languishing in jail since 17.05.2025 though, against him there is criminal antecedent of one case lodged under the offences of Excise Act but the same relates to the alleged theft of vehicle as well as recovery of liquor, against this petitioner investigation has been completed, in fact the petitioner was apprehended by

No.51311 of 2025(3) dt.15-10-2025 2/2 the police due to confusion and the Excise Pupri P.S. case no. 54 of 2025 was lodged for the recovery of the liquor and motorcycle from his possession and during the course of investigation the police did not take any attempt to investigate commission of the alleged theft of vehicle on the basis of CCTV footage. It is lastly submitted that the instant matter relates to the theft of informant's motorcycle and the same has been recovered.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the facts and circumstances of this case and mainly taking into account the petitioner's young age and his custody period and completion of investigation against him, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Sheohar P.S. Case No. 42 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
