2. The petitioner is languishing in custody since 23.11.2025 and is seeking regular bail in connection with NDPS Case No. 87 of 2025 arising out of Begusarai Town P.S. Case No. 492 of 2025 registered under sections 8, 20(b)(ii)(B) of the NDPS Act.
3. As per FIR allegation, 18 kg of Gaanja has been recovered from the possession of the accused persons. It has specifically been alleged that while 12 kg of the Gaanja has been recovered from the joint possession of the petitioner and Sonam Kumari and 6 kg Gaanja has been recovered from other Amresh Kumar.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case, learned counsel further submits that he has a clean antecedent and as such he is in

Learned counsel for the petitioner next submits that the quantity which has been recovered from the joint possession of the petitioner and one Sonam Kumari will fall in the ambit of intermediate quantity, He next submitted that other coaccused persons namely Sonam Kumari as well as Amresh Kumar of this case have been granted bail by a co-ordinate Bench of the Court in Cr. Misc. No. 24225/2026 and Cr. Misc. No. 40106/2026 respectively.
5. Learned APP for the State has stated that 18 kg Ganja have been recovered from possession of petitioner and co-accused persons.

Taking into consideration the aforesaid facts and circumstances coupled with the fact that intermediate quantity has been recovered from the joint possession of the petitioner and the other co-accused persons and also the fact that other co-accused persons have already been granted bail by a co-ordinate Benches of this Court and the fact that the petitioner has no criminal history, prayer for bail is allowed and the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned District & Addditional Sessions Judge 1st - cum - Special Judge NDPS Act & P.O. of Children Court, Begusarai/Concerned Court in connection with NDPS Case No. 87
Patna High Court CR. MISC. No. 49808 of 2026(2) dt.22-07-2026 3/3 of 2025 arising out of Begusarai Town P.S. Case No. 492 of 2025, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial. (ii) One of the bailors must be close relatives of the petitioner such as mother, father, brother, sister or wife. (iii) Before release, the learned court below shall verify the criminal antecedent of the petitioner and if he is found involved in any other case except the present one, his bail bond shall not be accepted.
(iv) The petitioner will appear on each and every date fixed by the trial court and if, he fails to do so on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bond of the petitioner.
(v) It is also made clear that there shall not be any delay in verifying the criminal antecedent of the petitioner. (Raj Kumar, J) ashutosh/- U
