Petitioners are apprehending their arrest in connection with Gaighat P.S.Case No.369 of 2018 corresponding to G.R.No.6946 of 2018 , registered for offences punishable under Sections 341, 323, 324, 379, 307, 504, 506, 147 of the Indian Penal Code.
Allegation as per the FIR is that while the informant was harvesting crops the accused persons came variously armed and on the order of the petitioner no.1, co-accused Vidyanand Ray assaulted by Farsa on the head of the informant and when
Patna High Court CR. MISC. No.46945 of 2019(2) dt.30-07-2019 2/2 his brother came on hulla he was also assaulted by Jitendra Ray by Farsa.
Submission of the learned counsel for the petitioners is that there is land dispute between the parties and no specific allegation has been attributed against the petitioners and except against petitioner no.1 that he is order-giver. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Judge-16-cum-A.C.J.M.-15, Muzaffarpur in connection with Gaighat P.S.Case No.369 of 2018 corresponding to G.R.No.6946 of 2018, subject to conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
