Learned counsel for the appellant is permitted to make necessary correction in Interlocutory Application No. 1149/2012 during course of the day. This appeal has been preferred against order dated 19.08.2010 passed by Railways Claim Tribunal, Patna Bench, Patna, in Claim Case No. OC 00537/2000, mainly on being inspired from composite order of this Court dated 06.3.2013 passed in M.A. No. 441/2011 with Analogous Cases, but the appeal is preferred almost a quarter and a year after the period of limitation. There appears no cogent and convincing reason to explain such delay. It is undisputed that payment against award has already been paid.

Hence, this Interlocutory Application appears
