Heard learned counsel for the petitioner, learned APP for the State and learned counsel for opposite party no.2. Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioner apprehends his arrest in connection with Runnisaidpur P.S. Case No. 224 of 2020 registered for the offences under Sections 498(A)/34 of the Indian Penal Code. Pursuant to the order dated 03.02.2022, notice was

It has been submitted by Mr. Vikash Kumar Jha, learned counsel for the petitioner that both the parties are now staying together and, therefore, the petitioner may be granted anticipatory bail.

Considering the aforesaid submission, the anticipatory bail application is allowed.

Accordingly, let the petitioner, named above, in the event of his arrest or surrender before the court below within eight weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 224 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. At the time of acceptance of bail bonds, the husband and wife (both) shall be personally present in Court below and only after verifying the fact - whether the wife is staying with the petitioner, the bail bond of the petitioner shall be accepted. If it is found by the Court below that the wife is not staying with the petitioner, then the petitioner shall be taken into custody forthwith.
