The instant application has been filed by the petitioner for extension of the time granted to the petitioner to surrender in order dated 27.2.2020 passed in Cr. Misc. no. 61898 of 2019 whereby while granting bail in connection with Complaint Case no. 1263(C) of 2016, the petitioner was directed to surrender within a period of six weeks.

It is submitted by learned counsel for the petitioner that for reasons beyond his control and as stated in the modification application, the petitioner could not surrender within the time fixed. It is further stated that a supplementary

Patna High Court CR. MISC. No. 64397 of 2021(3) dt.05-01-2022 2/2 affidavit has been filed bringing on record a copy of the receipt issued by the Patna High Court Legal Services Committee to the effect of the petitioner having deposited a sum of Rs. 5,000/-. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the materials on record, the order dated 27.2.2020 (Annexure-1) passed in Cr. Misc. no. 61898 of 2019 is modified to the extent that the direction contained therein for the petitioner to surrender in the learned Court below is extended by a further period of four weeks from today. The remaining part of the order remains unchanged. The application stands allowed to the above extent. (Partha Sarthy, J) Prakash/- U
