JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-08-2024 At the outset, learned counsel for the petitioners informs that during pendency of this case, petitioner no. 3 namely VIR BAHADUR JHA @ VIRBAADUR JHA died and as such, he seeks permission to withdraw this anticipatory bail petition in respect of petitioner no. 3 only.

2. Accordingly, this anticipatory bail petition is dismissed in respect of petitioner no. 3.

In respect of petitioner nos. 1, 2, 4 and 5

3. Heard learned counsel for the petitioners and learned A.P.P. for the State.

4. The petitioners apprehend their arrest in a case

Patna High Court CR. MISC. No.51051 of 2023(8) dt.07-08-2024 2/3 registered for the offence under Sections 302, 304(B) / 34 of the Indian Penal Code.

5. It is alleged that sister of the informant was married with co-accused Sanjay Kumar Jha 8 years ago and on 08.05.2023, the informant received an information that his sister has died and as such, the informant alongwith others went to the matrimonial house of deceased, where he did not get any satisfactory answer of the death of his sister. The informant suspects that all the six FIR named accused persons have killed his sister by administering her poison.

Petitioner no. 1 is elder brother-in-law (tsB), petitioner no. 2 is his wife (tsBkuh), petitioner no. 4 is mother-inlaw (lkl) and petitioner no. 5 is brother-in-law (uunksbZ) respectively of the deceased. There is general and omnibus allegation. Thrust of the accusation is against husband of the deceased, who is already in custody since 29.07.2024. Petitioners are separate in mess and property and have got no concern with the family affairs of deceased and her husband.

7. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of petitioners.

8. However, considering the aforesaid facts and circumstances, let the above named petitioners, in the event of

No.51051 of 2023(8) dt.07-08-2024 3/3 arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Tajpur (Halai) P.S. Case No. 249 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
