This application has been filed for issuance of writ in the nature of Certiorari or for quashing the order dated 30.06.2017 passed by learned Sub- Divisional Judicial Magistrate, East Muzaffarpur in connection with Mithanpura P.S. Case No. 71 of 2010. Petitioner has lodged this case for taking cognizance against the accused person. At the outset, learned counsel for the State submits that similar issue has already been set at rest by a co-ordinate bench of this Court vide order dated 09.09.2022, passed in CR.W.J.C No. 153 of 2017 ( Surendra Singh vs. State of Bihar and others.) and other analogous cases.

Since, similar issue has already been decided by a coordinate bench of this Court, this criminal writ petition is also

Patna High Court CR. WJC No.2449 of 2017(3) dt.17-02-2023 2/2 disposed of in terms of aforesaid order.

With the aforesaid liberty, this writ application stands disposed of.
