Petitioner is named in the first information report but according to prosecution case itself, it were co-accused, Sachin Yadav and Ajit Yadav who shot fire on the deceased and so far as petitioner is concerned, he happens to be only a member of unlawful assembly.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.2283 of 2016 (2) dt.25-01-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No. 153 of 2014.
