The petitioners are apprehending arrest in a case registered for the offences punishable under sections 272 and 273 of the Indian Penal Code and section 47(a) of the Excise Act. The prosecution case is that the informant being S.I. of Police of Patkhouli police station got a secret information that the petitioners used to deal in illicit liquor whereupon a raid was laid when two persons escaped from the scene throwing a bag containing 115 bottles of country made liquor. Patna High Court Cr.Misc. No.6218 of 2016 (2) dt.09-02-2016 2/2 petitioners that recovery has not been made from the petitioners and only on suspicion the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Bagaha (Patkhouli) P.s. Case No. 433 of 2015 pending in the court of learned ACJM, Bagaha, West Champaran.
This application is disposed of with the aforesaid observation/direction.
